MEMBERSHIP TERMS AND CONDITIONS

Please read these membership Terms and Conditions carefully before registering on this site as a Member. If you do not agree to these Membership Terms and Conditions, then you should not register as a Member of MyBower.

The following terms and conditions govern the service that we offer to you. Upon completion and submission of your registration details you are deemed to have accepted, and will be bound by these Terms and Conditions (“the Conditions”), as amended and varied from time to time. Please also check our Privacy Policy before registering.

1. GENERAL

1.1. Terms and Conditions

1.1(a) By Registering as a Member you are deemed to have read and accepted these Terms and Conditions.

1.1(b) The Conditions set out what you must do and what you must not do when using the website.  It also sets out our obligations to you. If you breach any of these conditions we may decide to cancel your registration, or take other action as we see fit.

1.1(c) We may amend these Terms and Conditions from time to time by posting new terms and conditions on the website. These amendments take effect from the time of posting. Continued use by you following any amendments will constitute your acceptance of the new Terms and Conditions.

1.1(d) You agree to indemnify us for any and all claim, damages or legal fees made by a third party in respect of any matter or breach arising for your use of the Site or of any content posted by you that may breach any personal third party rights, or a violation of any law.

1.1(e) We reserve the right, in our sole discretion, to remove, reject any posting or to restrict, suspend or terminate your Membership at any time, without prior notice and without liability on our part.

1.2. Use of the website

1.2(a) Use of the website is for the personal use of Members only and may not be used for, or in connection with any commercial endeavours except those which are expressly or specifically authorised by us.

1.2(b) Unauthorised use of the website, including the collection of usernames and/or email addresses of Members for the purpose of sending unsolicited email or for any other unauthorised purpose including linking to the website is not allowed. Any commercial or unauthorised content may be removed without notice and may result in termination of Member registration.

1.2(c) Although members may trade or sell with other members by use of the website it is acknowledged that the website does not monitor these transactions and all barter, trade, sale or similar is undertaken at the sole risk of the member/s participating and the website and its operator/s will in no way be liable for any loss or damage incurred or sustained through the use of the website.

2. REGISTRATION

2.1. Registering for Use

2.1(a) You must register with us for use as a Member. Registration is free and does not oblige you to do anything, apart from those obligations dealt with in these Terms and Conditions.

2.1(b) You must be over eighteen (18) years of age to register as a Member or have your parents consent to become a member. If we discover, or have any reason to suspect you are not over 18 years of age, or we believe you have not obtained consent we may suspend or terminate your membership at our discretion and without notice

2.1(c) You agree that in registering for Membership you will not use a false or misleading name, or provide false or misleading information.

2.1(d) You must choose a user name and password. You are responsible for the security of your user name and password and you authorise us to assume that anyone using your user name and password is you or someone authorised by you.

3. PUBLIC PROFILE

3.1. Content

3.1(a) Your public profile is available to other users and may not include the following information:

(i) telephone numbers
(ii) street addresses
(iii) family or surnames
(iv) photographs containing nudity, violence, racial or sexually explicit material

3.1(b) By displaying or posting any information on your bower you affirm and warrant that you are the rightful owner of the material and/or copyright, or that you have actual authority to so deal with the material.

3.2. Restricted content

3.2(a) You may not post anything that is likely to insult or offend, or is likely to breach the laws of a Member’s country. By example you may not post anything that:
(i) is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
(ii) harasses or advocates harassment of another person;
(iii) exploits people in a sexual or violent manner;
(iv) contains nudity, violence, or offensive subject matter or contains a link to an adult website;
(v) solicits personal information from anyone under 18;
(vi) provides any telephone numbers, street addresses, last names, URLs or email addresses;
(vii) promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
(viii) promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
(ix) involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spimming," or "spamming";
(x) contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
(xi) furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
(xii) solicits passwords or personal identifying information for commercial or unlawful purposes from other Users;
(xiii) involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes;
(xiv) includes a photograph of another person that you have posted without that person's consent

3.3. Restriction on use

3.3(a) Should we deem that you have breached this clause we reserve the right to remove anything which we deem inappropriate or we believe is calculated to offend or may infringe the laws of any country.

3.3(b) We also reserve the right to suspend, restrict or cancel your membership at any time and without prior notice if, in our discretion, you have breached the intent of this clause.

4. COPYRIGHT AND INTELLECTUAL PROPERTY

4.1. Membership of the site, or use thereof, creates no proprietary rights to the Member.

4.2. You may not copy, reproduce, republish, download, broadcast or communicate in any way information obtained from the Site for commercial or other purposes except for your own non-commercial use.

5. COMPLAINTS AND FEEDBACK

5.1. You are solely responsible for any interaction and/or disputes between yourself and any other Member. We have no obligation to monitor disputes or to take any action against you or any other Member.
